What if we opt for a Collaborative Divorce and our negotiations go bad – can we still go to court?

Answer

If you opt for a Collaborative Divorce, you still have the right to go to court.  However, if you do so, you and your spouse must each hire new attorneys.  Collaborative Law attorneys are required to withdraw from the case if litigation becomes necessary.  This ensures that the attorneys are committed to the process.
